President Biden has been found guilty of violating the First Amendment rights of the American people by ordering Big Tech to illegally censor citizens\u2019 opinions related to the 2020 election, a federal court has ruled.<\/strong><\/p>\n

The Fifth Circuit Court of Appeals ordered an injunction on an agency within the Department of Homeland Security (DHS) after finding that it violated free speech rights by coordinating with social media companies to censor Americans\u2019 right to free speech.<\/p>\n

On Tuesday, the court extended the scope of an\u00a0injunction in place\u00a0that limits the President Biden\u2019s ability to communicate with Big Tech companies.<\/p>\n

Neon Nettle reports: The injunction will now include the Cybersecurity and Infrastructure Security Agency (CISA) within the DHS.<\/p>\n

According to GOP Missouri Attorney General Andrew Bailey, who is leading the litigation against the Biden administration, CISA is the \u201cnerve center\u201d of the White House\u2019s \u201cvast censorship enterprise\u201d and \u201cthe very entity that worked with the FBI to silence the\u00a0Hunter Biden laptop story.\u201d<\/p>\n

\u201cCISA was created to protect Americans from foreign attack, and now it has begun targeting its own citizens,\u201d Bailey said in a statement.<\/p>\n

A three-judge panel determined in the court order that CISA was the \u201cprimary facilitator\u201d of the\u00a0FBI\u2019s interactions with the social media platforms and worked in close coordination with the FBI to push the platforms to change their moderation policies to cover \u201chack-and-leak\u201d content.<\/p>\n

The opinion describes CISA\u2019s \u201cswitchboarding\u201d operations as \u201cmerely relaying flagged social-media posts from state and local election officials to the platforms.\u201d<\/p>\n

However, the judge said that \u201cin reality, the practice ended up being \u2018[s]omething more,\u2019\u201d the order reads.<\/p>\n

\u201cCISA used its frequent interactions with social media platforms to push them to adopt more restrictive policies on censoring election-related speech,\u201d it continues.<\/p>\n

\u201cAnd CISA officials affirmatively told the platforms whether the content they had \u2018switchboarded\u2019 was true or false.<\/p>\n

\u201cThus, when the platforms acted to censor CISA-switchboard content, they did not do so independently.<\/p>\n

\u201cRather, the platforms\u2019 censorship decisions were made under policies that CISA has pressured them into adopting and based on CISA\u2019s determination of the veracity of the flagged information.<\/p>\n

\u201cThus, CISA likely significantly encouraged the platforms\u2019 content-moderation decisions and thereby violated the First Amendment,\u201d the judges said.<\/p>\n

The injunction stems from a lawsuit brought by Missouri and Louisiana attorneys general against the Biden administration that accused high-ranking government officials of working with giant social media companies \u201cunder the guise of combating misinformation.\u201d<\/p>\n

The effort ultimately led to censoring speech on topics, including Hunter Biden\u2019s laptop,\u00a0COVID-19 origins, and the efficacy of\u00a0face masks.<\/p>\n

The attorneys general deposed several officials, including\u00a0Dr. Anthony Fauci\u00a0and FBI Special Agent\u00a0Elvis Chan.<\/p>\n

On July 4, federal Judge Terry A. Doughty of the Fifth Circuit\u00a0ordered the first injunction, which prevents White House officials and federal agencies from meeting with tech companies about social media censorship, arguing that such actions likely violated the First Amendment.<\/p>\n

The scathing Independence Day injunction said the government\u2019s actions\u00a0during the pandemic\u00a0were akin to \u201can Orwellian \u2018Ministry of Truth.\u2019\u201d<\/p>\n

\u201cIf the allegations made by Plaintiffs are true, the present case arguably involves the most massive attack against free speech in\u00a0United States\u2019 history,\u201d the injunction continues.<\/p>\n

\u201cIn their attempts to suppress alleged disinformation, the Federal Government, and particularly the Defendants named here, are alleged to have blatantly ignored the First Amendment\u2019s right to free speech.\u201d<\/p>\n

The Justice Department has appealed the court order to\u00a0the Supreme Court.<\/p>\n
